1. Introduction

The ZingRally website (the “Site”) is owned and operated by ZingThis, LLC, doing business as ZingRally (“ZingRally,” “we,” “us,” or “our”) — a Maryland limited liability company. ZingRally is a property tax sale surplus recovery service that assists former property owners in identifying and reclaiming unclaimed surplus funds held by county governments and state agencies in Maryland, Virginia, Florida, Ohio, Colorado, North Carolina, Pennsylvania, South Carolina, Tennessee, and other states .

By using the Site, you agree to be bound by these Terms of Use and to use the Site in accordance with these Terms of Use, our Privacy Policy, our Terms of Service, and any additional terms that may apply to specific sections of the Site or services available through ZingRally.

Accessing the Site, in any manner, whether automated or otherwise, constitutes use of the Site and your agreement to be bound by these Terms of Use.

We reserve the right to change these Terms of Use or to impose new conditions on use of the Site from time to time, in which case we will post the revised Terms of Use with a new effective date. By continuing to use the Site after we post any such changes, you accept the Terms of Use as modified.

Important Disclosure — Your Right to File Without Us

FORMER PROPERTY OWNERS HAVE THE RIGHT TO FILE SURPLUS FUND CLAIMS THEMSELVES AT NO COST THROUGH THEIR COUNTY FINANCE DEPARTMENT OR DIRECTLY AT CLAIMITMD.COM. ZINGRALLY’S SERVICE IS OPTIONAL AND PROVIDED FOR YOUR CONVENIENCE. YOU ARE UNDER NO OBLIGATION TO USE ZINGRALLY TO RECOVER YOUR FUNDS.

1.1 Parent Company

ZingRally operates separately from ZingThis LegacyLoop. For information about ZingThis LegacyLoop — our creator visibility platform — please visit zingthis.com. The two services are governed by separate legal documents.


2. Intellectual Property Rights

2.1 Our Limited License to You

The Site and all materials available on the Site are the property of ZingThis, LLC and/or our affiliates or licensors, and are protected by copyright, trademark, and other intellectual property laws. The Site is provided solely for your personal, non-commercial use in connection with learning about and engaging ZingRally’s surplus recovery services.

You may not use the Site or the materials available on the Site in a manner that constitutes an infringement of our rights or that has not been authorized by us. Unless explicitly authorized in these Terms of Use or by the owner of the materials, you may not: modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works, exploit, or distribute in any manner any material from the Site; use automated tools, bots, or scrapers to collect or harvest content from the Site; remove, alter, or obscure any copyright, trademark, or other proprietary notices; or use the Site or its content for any commercial purpose without our express written permission.

You may, from time to time, download and/or print one copy of individual pages of the Site for your personal, non-commercial use, provided that you keep intact all copyright and other proprietary notices.

2.2 Your License to Us

By posting or submitting any material to us via the Site, contact forms, email, or otherwise, you are representing: (a) that you are the owner of the material, or are making your submission with the express consent of the owner; and (b) that you are eighteen (18) years of age or older.

When you submit, email, or deliver any material to us, you grant us, and anyone authorized by us, a royalty-free, perpetual, irrevocable, non-exclusive, unrestricted, worldwide license to use, copy, modify, transmit, and distribute such material solely for the purposes of providing our surplus recovery services and operating our business. You also grant us the right to identify you as the author of any submissions as we deem appropriate. You waive any moral rights you may have in such material.

2.3 Work Made for Hire

You acknowledge and agree that any contributions originally created by you for us in the course of our services shall be deemed a “work made for hire” when the work performed is within the scope of the definition of a work made for hire in Section 101 of the United States Copyright Law, as amended. As such, the copyrights in those works shall belong to ZingThis, LLC from their creation.

In the event that any results and proceeds of your submissions are not deemed a “work made for hire” under Section 101 of the Copyright Act, you hereby, without additional compensation, irrevocably assign, convey, and transfer to ZingThis, LLC all proprietary rights, including without limitation all copyrights and trademarks throughout the universe, in perpetuity in every medium, whether now known or hereafter devised.

2.4 Limitations on Linking and Framing

You may establish a hypertext link to the Site so long as the link does not state or imply any sponsorship of your site by us. However, without our prior written permission, you may not: frame or inline link any content of the Site; incorporate into another website any of our material, content, or intellectual property; use our trademarks, logos, or branding without authorization; or create a false affiliation or association with ZingRally or ZingThis, LLC.


3. Disclaimers

3.1 Third-Party Links

Throughout the Site, we may provide links to Internet sites maintained by third parties, including county government websites, the Maryland State Comptroller’s website, and other public resources. Our linking to such third-party sites does not imply an endorsement or sponsorship of such sites. You access third-party sites at your own risk and should review the terms of use and privacy policies of any third-party sites you visit.

3.2 Third-Party Information

Any opinions, advice, statements, services, offers, or other information expressed or made available by third parties — including county government agencies, state agencies, or other public sources — are those of the respective authors or agencies, and not ZingRally. ZingRally neither endorses nor is responsible for the accuracy and reliability of information obtained from county or state government sources, public records, or any third-party websites.

3.3 Accuracy of Public Records

ZingRally relies on publicly available county surplus fund lists, the Maryland SDAT database, Virginia property records, and the Maryland State Comptroller’s unclaimed property database to identify potential surplus fund claims. We make no warranty that these public records are complete, accurate, current, or free from error. The existence of a name on a surplus fund list does not guarantee that funds are available, eligible for claim, or recoverable.

3.4 General Disclaimer

THE INFORMATION, SERVICES, AND MATERIALS OFFERED ON OR THROUGH THE SITE AND BY ZINGRALLY AND ANY THIRD-PARTY SITES ARE PROVIDED “AS IS” AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO: IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE; WARRANTIES OF TITLE AND NON-INFRINGEMENT; WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT; WARRANTIES THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; AND WARRANTIES THAT ANY SURPLUS FUND CLAIM WILL BE SUCCESSFUL.

3.5 Indemnification

You agree at all times to defend, indemnify, and hold harmless ZingThis, LLC d/b/a ZingRally, its affiliates, their successors, transferees, assignees, and licensees and their respective parent and subsidiary companies, agents, associates, officers, directors, shareholders, and employees from and against any and all claims, causes of action, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: your breach of any obligation, warranty, representation, or covenant set forth herein; your violation of any applicable laws or regulations, including those governing surplus fund claims; your provision of false or fraudulent information in connection with a surplus claim; your lack of legal authority to act on behalf of a former property owner; your violation of any third-party rights; or your use or misuse of the Site or ZingRally’s services. This indemnification obligation will survive termination of your use of the Site.


4. Use of the Site and Services

4.1 Permitted Use

The Site is provided for the purpose of learning about ZingRally’s surplus recovery services, submitting contact and inquiry forms, signing Client Service Agreements electronically, and communicating with ZingRally regarding your surplus fund claim. All use of the Site must be for lawful purposes and in accordance with these Terms of Use.

4.2 Contact Forms and Electronic Agreements

ZingRally uses JotForm to collect contact form submissions and electronic signatures for Client Service Agreements. By submitting a contact form or signing a Client Service Agreement electronically through the Site, you agree that your electronic signature is legally binding to the same extent as a handwritten signature under the Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and applicable Maryland law. You will receive a copy of any signed agreement via email at the address you provide.

4.3 Accuracy of Information Submitted

You agree to provide accurate, current, and complete information in all contact forms, inquiry submissions, and Client Service Agreements. Providing false, misleading, or fraudulent information through the Site is a violation of these Terms, may constitute fraud under applicable state law, and may result in immediate termination of services and referral to appropriate authorities.

4.4 No Upfront Fees Through the Site

ZingRally does not charge any upfront fees, retainers, application fees, or processing fees through the Site or otherwise. Any communication — whether through the Site, email, phone, or any other channel — requesting upfront payment and claiming to be from ZingRally is not authorized. Please report any such request to [email protected] immediately.

4.5 Payment Issues

ZingRally’s standard service fee is 10% of the total amount successfully recovered on your behalf, contingency-based and due only upon successful recovery of your surplus funds, as set forth in your Client Service Agreement. If a dispute arises regarding payment of the service fee after successful recovery, ZingRally will attempt to resolve it in good faith. Failure to pay an agreed service fee after successful recovery may result in legal action to collect the amount owed.


5. Prohibited Uses

You agree not to use the Site or ZingRally’s services for any of the following purposes:

  • Any unlawful purpose or in violation of any applicable laws or regulations
  • To submit false, fraudulent, or misleading information in any contact form, inquiry, or Client Service Agreement
  • To attempt to claim surplus funds to which you are not legally entitled
  • To file a claim on behalf of another person without proper legal authorization
  • To modify, copy, reproduce, republish, or distribute any content from the Site without our express written permission
  • To use automated tools, bots, or scrapers to collect or harvest content from the Site
  • To interfere with or disrupt the Site or any servers or networks connected to the Site
  • To impersonate any person or entity or falsely represent your authority to act on another’s behalf
  • To upload or transmit viruses, malware, ransomware, or any other harmful component
  • To harass, abuse, harm, defame, or intimidate ZingRally personnel or affiliated parties
  • To use the Site or ZingRally’s name, logo, or branding to misrepresent an affiliation or endorsement

Violation of this section may result in immediate termination of services, forfeiture of any pending claim assistance, and referral to appropriate law enforcement or state authorities.


6. Registration and Identity Verification

6.1 Contact and Inquiry Submissions

To engage ZingRally’s services, you will provide your name, email address, phone number, and property information through our contact forms. You agree to provide true, accurate, current, and complete information. If we have reasonable grounds to suspect that such information is untrue, inaccurate, or incomplete, we have the right to decline or terminate services.

Our use of any personally identifiable information you provide is governed by the terms of our Privacy Policy at zingrally.com.

6.2 Identity Verification for Claims

To process your surplus fund claim, you will be required to provide a government-issued photo ID, proof of prior property ownership, and any other documentation required by the relevant county or state agency. You must be at least 18 years of age to engage ZingRally’s services or sign a Client Service Agreement.

6.3 Age Requirement

You must be at least 18 years of age to use the Site or engage ZingRally’s services. By using the Site or signing a Client Service Agreement, you represent and warrant that you are 18 years of age or older.


7. Limitation of Liability

7.1 General Limitation of Liability

UNDER NO CIRCUMSTANCES, INCLUDING BUT NOT LIMITED TO NEGLIGENCE, SHALL ZINGTHIS, LLC d/b/a ZINGRALLY, ITS SUBSIDIARY AND PARENT COMPANIES OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES THAT RESULT FROM: THE USE OF, OR THE INABILITY TO USE, THE SITE; OUR SERVICES, COMMUNICATIONS, OR MATERIALS; THE ACTIONS OR INACTIONS OF COUNTY OR STATE GOVERNMENT AGENCIES IN PROCESSING SURPLUS CLAIMS; UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR CLAIM INFORMATION OR DOCUMENTS; STATEMENTS OR CONDUCT OF ANY THIRD PARTY; OR ANY OTHER MATTER RELATING TO THE SITE OR OUR SERVICES. THIS LIMITATION APPLIES EVEN IF WE ARE ADVISED BEFOREHAND OF THE POSSIBILITY OF SUCH DAMAGES.

IF YOU ARE DISSATISFIED WITH THE SITE, ANY MATERIALS OR SERVICES, OR WITH ANY OF THESE TERMS AND CONDITIONS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE AND ZINGRALLY’S SERVICES.

7.2 Advisory Services Disclaimer

ZINGRALLY IS NOT A LAW FIRM, LEGAL ADVISOR, FINANCIAL ADVISOR, TAX ADVISOR, OR INVESTMENT ADVISORY SERVICE. WE DO NOT PROVIDE LEGAL REPRESENTATION OR PERSONALIZED LEGAL, FINANCIAL, OR TAX ADVICE. OUR SERVICES ARE LIMITED TO RESEARCHING PUBLIC RECORDS AND ASSISTING WITH THE ADMINISTRATIVE PREPARATION AND SUBMISSION OF SURPLUS FUND CLAIMS. YOU ARE RESPONSIBLE FOR CONSULTING QUALIFIED LEGAL AND FINANCIAL PROFESSIONALS BEFORE MAKING ANY DECISIONS RELATED TO YOUR SURPLUS CLAIM OR THE RECOVERED FUNDS.

7.3 No Guarantee of Recovery

YOU ACKNOWLEDGE AND AGREE THAT NO REPRESENTATION HAS BEEN MADE BY ZINGRALLY OR ITS AFFILIATES GUARANTEEING THE SUCCESSFUL RECOVERY OF ANY SURPLUS FUNDS. RECOVERY DEPENDS ON FACTORS OUTSIDE ZINGRALLY’S CONTROL INCLUDING BUT NOT LIMITED TO: THE SPECIFIC COUNTY’S CLAIM PROCEDURES, THE EXISTENCE AND AMOUNT OF SURPLUS FUNDS, COMPETING CLAIMS FROM LIENHOLDERS OR HEIRS, YOUR ABILITY TO PROVIDE REQUIRED DOCUMENTATION, AND APPLICABLE STATE AND LOCAL LAW. ZINGRALLY IS NOT LIABLE FOR ANY UNSUCCESSFUL CLAIM OR FOR ANY DELAY IN THE RECOVERY PROCESS CAUSED BY COUNTY OR STATE AGENCIES.


8. Termination

8.1 Termination Rights

We may cancel or terminate your use of the Site or our services at any time without notice for: violation of these Terms of Use; violation of our Terms of Service; provision of false or fraudulent information; your inability or unwillingness to provide required documentation; suspected fraudulent, abusive, or illegal activity; or any other reason at our sole discretion. In the event of termination, you are no longer authorized to use the Site or engage ZingRally’s services.

8.2 Effect of Termination

The disclaimers and limitations of liabilities set forth in these Terms of Use shall survive termination. Upon termination: ZingRally will cease all activities on your behalf; you must cease all use of the Site; you remain liable for all obligations incurred prior to termination, including any service fee owed for work already performed; and no refunds will be issued for any fees already paid.


9. Copyright Complaints (DMCA)

9.1 DMCA Compliance

The Digital Millennium Copyright Act of 1998 (the “DMCA”) provides recourse for copyright owners who believe that material appearing on the Internet infringes their rights under U.S. copyright law. If you believe in good faith that materials hosted by ZingRally infringe your copyright, you or your agent may send ZingRally a notice requesting that the material be removed or access to it be blocked. Any notification that fails to comply with the requirements of the DMCA shall not be considered sufficient notice.

9.2 Counter-Notice

If you believe in good faith that a notice of copyright infringement has been wrongly filed against you, the DMCA permits you to send ZingRally a counter-notice. All notices and counter-notices must meet the then-current statutory requirements imposed by the DMCA; see http://www.loc.gov/copyright for details.

10. General Provisions

10.1 Assignment

This Agreement shall be binding upon and inure to the benefit of ZingThis, LLC d/b/a ZingRally and our respective assigns, successors, heirs, and legal representatives. Neither this Agreement nor any rights hereunder may be assigned by you without the prior written consent of ZingRally. All rights and obligations under this Agreement may be freely assigned by ZingRally to any affiliated entity or wholly-owned subsidiary, or in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets.

10.2 Governing Law and Jurisdiction

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law principles. Any dispute shall be subject to binding arbitration in Garrett County, Maryland in accordance with the Commercial Arbitration Rules of the American Arbitration Association (AAA). You waive any right to participate in class action lawsuits, class arbitrations, or a jury trial.

10.3 Severability

If any provision of this Agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.

10.4 Entire Agreement

These Terms of Use, together with our Terms of Service, Privacy Policy, and any signed Client Service Agreement, constitute the entire agreement between you and ZingRally concerning your use of the Site and our services.

10.5 Waiver

Our failure to enforce any right or provision of these Terms of Use will not be considered a waiver of those rights. Any waiver must be in writing and signed by an authorized representative of ZingRally.

10.6 Headings

Section headings in these Terms of Use are for convenience only and shall not govern the meaning or interpretation of any provision.

10.7 Force Majeure

ZingRally shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to: acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, delays by county or state government agencies, or shortages of resources.

10.8 Modifications to Terms

We reserve the right to modify these Terms of Use at any time, effective upon posting the updated Terms on zingrally.com with a new effective date. Your continued use of the Site after any changes constitutes your acceptance of the modified Terms. For material changes, we will make reasonable efforts to notify you via email.

BY USING THIS SITE OR ENGAGING ZINGRALLY’S SERVICES, YOU ACKNOWLEDGE THAT:

  • You have read these Terms of Use in their entirety
  • You understand and agree to be legally bound by these Terms of Use
  • You are at least 18 years of age
  • You agree to the arbitration and class action waiver provisions
  • You will not violate any intellectual property rights
  • You will use the Site for lawful purposes only
  • You understand that you have the right to file a surplus claim yourself at no cost without using ZingRally
  • You understand that ZingRally makes no guarantee of successful recovery
  • You understand that ZingRally is not a law firm and does not provide legal representation or advice
  • You agree to provide accurate and truthful information in all contact forms and claim documentation
  • You understand that your electronic signature on a Client Service Agreement is legally binding
  • Maryland clients understand their 10-day right of rescission as provided by Maryland Real Property Article §§ 7-314 and 7-315
  • You are solely responsible for any tax implications of receiving recovered surplus funds
  • You understand that results are not guaranteed

IF YOU DO NOT AGREE TO THESE TERMS OF USE, YOU MUST NOT USE THIS SITE OR ENGAGE ZINGRALLY SERVICES.
